ROLE OF A MEDIATOR

“Amidst the resounding noise, I tune into your voice,

When unbridled emotions overrun, Unbiased I hang on

Quelling commotions, aiding options and solutions ,

Together treading towards peace, oh !the conflict to cease”


What makes a successful mediator is a topic of great speculation. A mediator’s role is a formidable task, though one of great significance in a mediation process. A real mediator respects the canons of mediation, S/he is committed to the process, and has a definitive role that demonstrates integrity and impartiality, neutrality and fierce independence, good communication skills, besides one that exhibits patience and understanding all through the process.


A mediator needs inherent coherence to assess what is actually feasible in contrast to what is desired by either of the parties and assist the parties to accept their reality without being persuasive . A mediator is an intervener who possesses the ability to stimulate mutual trust and understanding between the parties that the warring parties are able to perceive their dispute in the luminosity of mutual recognition and therefore open themselves to explore possibilities of a settlement.


A good mediator is an epitomy of positive attributes. A mediator has ears open for the said and the unsaid, though the mind is devoid of any judgment. A mediator controls the process. s/he uses shuttle diplomacy while conveying to the other party. In other words a problem is communicated to the opposite party from a perspective that reduces the sting, eases the stress and quite likely increases the chances of a constructive response. The propensity to be articulate and empathize is another trait on which a mediator trails . A mediator is a conduit of reality as s/he helps the parties themselves to understand the practicality of the position they hold on to. A mediator’s conviction in the power and ability of parties to solve their own conflicts is reflected throughout the mediation process.


To conclude, a mediator is a multifaceted personality wearing different hats during the process of mediation, though all the time functioning within the paradigm of the ethics of mediation. A mediator begins by opening the communication channels in an atmosphere of hostility, s/he moves on to the role of a facilitator who facilitates the process, further moving on to the role of a problem identifier, then stepping into a creative role of aiding the parties in exploring and expanding options, and finally it is the rationale of a consensus assisted and sealed with an outcome in which the mediator has no stakes whatsoever.
